Welcome to PhantomCart. These Terms of Service ("Terms") govern your use of the PhantomCart website, application, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Service Description

PhantomCart is a parody food-delivery simulator — a gamified, fake delivery app designed as a behavioral financial wellness tool. The Service allows users to browse fictional restaurant menus, build virtual shopping carts, go through a simulated checkout flow, receive phantom delivery countdowns, and track cumulative "savings" from orders not actually placed.

Parody Disclaimer: PhantomCart does not facilitate real food delivery. No actual orders are placed. No real restaurants are engaged. No couriers are dispatched. No food is prepared or delivered. No real payments are processed through the free version of the Service. All restaurant names, menu items, prices, delivery times, and order confirmations are fictional and presented for entertainment and behavioral-reflection purposes only. Any resemblance to real restaurants, menu items, or delivery services is coincidental and part of the parody.

2. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under the age of majority in your jurisdiction, you must have a parent or legal guardian read and accept these Terms on your behalf.

3. Account and User Identity

PhantomCart does not require account registration, email verification, or password creation for the free version. Your identity within the Service is tied to a randomly generated device identifier (UUID) stored in your browser's LocalStorage. You are responsible for maintaining the security of your device. We do not authenticate users or verify identities — this is a parody app, not a bank.

4. PhantomCart Pro (Paid Tier)

PhantomCart may offer an optional paid subscription tier ("PhantomCart Pro") that unlocks additional features such as multi-restaurant ordering and advanced Savings Reports. The Pro tier involves real payment processing through standard third-party payment providers. Pricing, billing cycles, and cancellation policies will be clearly presented at the point of purchase. You may cancel your Pro subscription at any time; cancellation takes effect at the end of the current billing period. All Pro fees are charged in U.S. dollars and are non-refundable except as required by applicable law.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service in any way that violates applicable laws or regulations
  • Attempt to interfere with, compromise, or disrupt the Service or its servers
  • Reverse-engineer, decompile, or extract the source code of the Service
  • Use automated means (bots, scrapers, scripts) to access the Service in a manner that imposes an unreasonable load on our infrastructure
  • Attempt to place real orders, submit real payment information through the free tier, or otherwise use the Service in a way that contradicts its stated parody purpose
  • Use the Service to harass, defraud, or impersonate others

6. Intellectual Property

The Service, including its code, design, graphics, text, game mechanics, mascot characters, and the "PhantomCart" name and logo, is owned by PhantomCart Inc. and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

The fictional restaurant names, menu item descriptions, and pricing structures within the Service are parody content and are not intended to infringe on any third party's intellectual property. If you believe any content within the Service infringes your rights, please contact us at the email below.

7. User-Generated Content

The Service allows you to customize certain aspects of your experience (e.g., display name, address label). You retain ownership of any content you input. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display that content solely for the purpose of operating and improving the Service. You represent that any content you submit does not violate third-party rights or applicable laws.

8. Third-Party Services

The Service may integrate with third-party services such as payment processors (for PhantomCart Pro), push notification services (Web Push API), and analytics providers. We are not responsible for the practices, content, or availability of these third-party services. Your use of such services is subject to their respective terms and policies.

9. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. To the fullest extent permitted by law, PhantomCart Inc. disclaims all warranties, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties that the Service will be uninterrupted, error-free, secure, or available at all times
  • Warranties regarding the accuracy, reliability, or completeness of any content (all of which is fictional and part of the parody)
  • Warranties that the Service will reduce your actual food delivery spending (it might, but we're not promising anything)

PhantomCart is a parody simulator and a behavioral tool, not a clinical intervention, financial advice service, or therapeutic product. It is not a substitute for professional financial counseling, mental health treatment, or medical advice.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PHANTOMCART INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to:

  • Loss of profits, data, use, or goodwill
  • Emotional distress arising from the realization that you almost spent $47 on delivery pad thai at midnight
  • Any actual food orders you place after using the Service ("the rebound effect")
  • Service interruptions, data loss from LocalStorage clearing, or push notification failures
  • Any conduct or content of any third party on or through the Service

Our total aggregate liability for any claims arising from or relating to these Terms or the Service shall not exceed the greater of: (a) the amount you paid us in the 12 months preceding the claim, or (b) $50 USD. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless PhantomCart Inc. and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) your submission of content through the Service.

12. Termination

We reserve the right to suspend or terminate your access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is otherwise harmful to the Service, other users, or third parties.

You may terminate your use of the Service at any time by simply stopping use. To remove your data, clear your browser's LocalStorage for our domain or use the "Delete Profile" feature within the app. For PhantomCart Pro subscribers, you may cancel your subscription through the app or by contacting us.

Upon termination, provisions of these Terms that by their nature should survive will survive, including but not limited to: Intellectual Property, Warranty Disclaimer, Limitation of Liability, Indemnification, and Governing Law.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will make reasonable efforts to notify you through the Service or via a prominent notice on our website. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any dispute arising from or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.

Before filing a formal legal claim, we encourage you to contact us first. We're reasonable people. Most issues can be resolved with a conversation — even for a parody app.

15. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from causes beyond our reasonable control, including but not limited to: natural disasters, war, terrorism, civil unrest, government action, internet infrastructure failures, or third-party service outages.

16. General Provisions

These Terms constitute the entire agreement between you and PhantomCart Inc. regarding the Service and supersede all prior agreements. If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
